1. Overview

This website and all related services are operated by Untitled Goods (“Company,” “we,” “our,” or “us”). By accessing our website, placing an order, requesting a quote, or engaging our services, you agree to be bound by these Terms & Conditions.


If you do not agree to these terms, do not use our services.

 

2. Nature of Business

Untitled Goods is a custom product design and sourcing studio specializing in private label apparel, accessories, packaging, and lifestyle goods.

Many of our products are:

  • Made-to-order

  • Custom manufactured

  • Produced overseas

  • Subject to extended lead times

 

3. Custom Orders – No Refund Policy

ALL CUSTOM, MADE-TO-ORDER, PRIVATE LABEL, OR PERSONALLY BRANDED PRODUCTS ARE NON-REFUNDABLE.

This includes but is not limited to:

  • Custom apparel

  • Custom hats

  • Private label goods

  • Custom packaging

  • Special production runs

  • Bulk production orders

  • Wholesale orders

Once production has begun, orders cannot be canceled.

Deposits are non-refundable.

Refunds will only be considered if:

  • The product is materially defective beyond agreed production tolerances.

  • The error is solely due to a confirmed manufacturing defect caused by Untitled Goods.

Minor variations in:

  • Color

  • Fabric texture

  • Stitching

  • Placement

  • Print alignment

  • Packaging finish

are considered normal manufacturing tolerances and are not grounds for refunds.

 

4. Production & Shipping Timeline

Due to overseas sourcing and custom manufacturing:

Production and shipping timelines may range from 60–90 days, and in some cases longer depending on:

  • Factory schedules

  • International holidays

  • Shipping carrier delays

  • Customs inspections

  • Raw material availability

These timelines are estimates only and are not guaranteed.

Untitled Goods is not responsible for delays caused by third-party manufacturers, shipping carriers, customs, weather, geopolitical events, or force majeure circumstances.

 

5. Payment Terms

  • Full payment may be required to initiate production.

  • Remaining balance must be paid before shipment.

  • Late payments may delay production or shipment.

  • We reserve the right to cancel projects for non-payment.

Chargebacks filed on valid custom orders will be aggressively disputed.

 

6. Intellectual Property

Clients confirm they own or have legal rights to all logos, trademarks, artwork, and branding submitted to Untitled Goods.

Untitled Goods is not responsible for trademark infringement claims resulting from client-submitted designs.

We reserve the right to photograph and use produced goods for marketing purposes unless otherwise agreed in writing.

 

7. Production Tolerances & Quality

All custom manufacturing is subject to industry-standard tolerances.

Acceptable tolerances may include:

  • ±5% sizing variance

  • Slight color variations between digital mockups and final product

  • Minor stitch or alignment variation

Digital mockups are representations and not exact physical proofs.

 

 

8. Limitation of Liability

Untitled Goods shall not be liable for:

  • Lost profits

  • Indirect or consequential damages

  • Delays outside our control

  • Market performance of produced goods

  • Client business losses

Our maximum liability shall not exceed the amount paid for the specific order in dispute.

 

9. Wholesale & Bulk Orders

All wholesale and bulk production orders are final sale.

Clients are responsible for confirming:

  • Sizing breakdowns

  • Color selections

  • Quantity counts

  • Artwork approval

Final approval from the client constitutes production authorization.

 

10. Indemnification

Client agrees to indemnify and hold harmless Untitled Goods from any legal claims arising from:

  • Copyright infringement

  • Trademark disputes

  • Misuse of produced goods

  • Resale liability

 

11. Governing Law

These Terms are governed by the laws of the State of Utah.

Any disputes shall be resolved in Salt Lake County, Utah.
